How will a DUI affect my California Nursing License?
California regulates Nurses through the California Board of Registered Nursing. After obtaining the required education, aspiring nurses take a National Council Licensure Exam. Also, they must go through a background fingerprint check. A fingerprint check is necessary because California requires all convictions to be reported, except minor traffic violations.
A DUI is not a minor traffic violation, so you must report it even if you have filed for expungement under Penal Code Section 1203.4.
Do I have to report a DUI from another state?
Yes, all convictions, including DUI’s from another state are required to be reported to the licensing board in California. Some applicants desire to omit their convictions from another state, which can lead to more problems in the long run. It is best to be upfront with your case. At Burga Law Firm PC, we are an experienced DUI Attorney. We can develop a plea agreement that will place in a better position favorable to the licensing board.
Can I still obtain a license as a registered nurse if convicted of a DUI?
Yes and no. The licensing board makes that determination of whether to approve or deny your license, even without evaluating your entire application and supporting documentation. They look at all of your convictions and how they happened.
What can I do to increase my chances of becoming a licensed nurse if I have a DUI conviction?
Having a DUI affect your California Nursing License can be a nightmare. However, the Board evaluates all applications on a case by case basis. They look at nature, severity, and how new was the offense, as well as rehabilitation and other factors.
Can a DUI automatically disqualify me from receiving a nursing license?
According to California, the answer is no. The board reviews on a case by case basis, all convictions and supporting documentation to determine if an application will be approved or denied.
